Is It Legal for a Male->Female Transsexual to Be Topless at the Beach?

I’m talking about the ones on Maury where they have had breast surgery and it’s sometimes hard to tell if it’s a man or woman.

This is a question that I asked another group once.
To begin with if the transwoman is well developed and is presenting female she can expect trouble. I even asked this of and ACLU attorney, btw. Simply put there are decency laws in most jurisdictions. These are often antiquated and archaic but laws nonetheless.
While a pre-op TS woman is legally considered male there would be those who would attempt to push their version of morals upon her. She would be cited or arrested for doing so. It would be very possible to win a case on the grounds that she is still legally male but is it worth the hassle?
Our present society in the US is mostly driven by the christian hate agenda and would find anyway to spread this hate.
In Windsor Canada a decade or more ago women sued the govt over the civil right of women to do just as men do and can be topless legally in the same places that men can be. Such as a beach or certain public places that do not have health code restrictions such as a restaurant. This is light years ahead of the archaic mindset in the US.
In the end while the logic is not substantive it is the laws and how they are perceived.

If it’s a topless beach, sure. Why not? Otherwise same laws would apply as to women.

Hmmm… I think it would depend on how the person was presenting themselves. Not to be gross, but I’ve seen plenty of guys at the beach who needed bras, so I don’t think it’s the breasts so much as it is the apparent gender of who is showing them.
